Well the thing is, making it is illegal, to brew it and to distill it is illegal. Their kit contains herbs and you are supposed to tend to them and then soak them in the alcohol for an extended period of time for the alcohol to take effect as the Absinth. They are infusing the herbs into the alcohol, therefore not distilling it and not necessarily making it, just altering it. It would be like adding a lemon to your water, but not actually brewing Lemon-Water. Idk if that really makes sense, thats just what i picked up from reading it all.

Exactly, this method is legal as you're just infusing alcohol, not making it.
