Actually, from what I've heard, Hilary Clinton was the one fighting for it to be changed.

Apparently the content was already on the disc but not inserted as a part of the game and probably encrypted. The guy who made the mod just figured out how to insert it into the game, made it as a mod and put it online. The ESRB is considering it as a "withheld part" of the game since it was on the disc.
